Udacity Referral Affiliate Review
HOW THE REFERRAL PROGRAM WORKS AND ELIGIBILITY FOR PARTICIPATION
In order to avail the benefits/rewards under the Referral Program, the Participants shall ensure compliance with the following:
a) The Referrer shall have a User Account.
b) The Referrer shall share the unique invite link (the "Invite Link") as provided by Udacity through the User Account with the Referred User via such communication medium as notified by Udacity in its sole discretion including but not limited to via email, Facebook, WhatsApp and Twitter.
c) The Referred User shall create a User Account only and only through the Invite Link.
d) The Referred User shall (A) subscribe to a Nanodegree by paying the Fees through the User Account and (B) not cancel her subscription to the Nanodegree.
e) Subject to the Referred Users' strict compliance with the RPT including but not limited to Clause (d) above, the Referred User shall be eligible for a refund of One Thousand Rupees (INR 1000/-) by Udacity. Such refund shall be made to the designated bank account of the Referred User within one (1) month from the date of her enrollment to the Nanodegree. It is referrers responsibility to provide correct bank account details to get the reward amount. In case any referrer provides incorrect bank details then Udacity would not be responsible for that mistake and would not be liable to send the reward amount again to the Referrer.
f) Subject to the Referrers' compliance with the RPT, the Referrer shall be paid One Thousand Rupees (INR 1000/-) by Udacity within one (1) month from the date of the Referred Users' enrollment to the Nanodegree, provided however, the Referred User has not cancelled her Nanodegree subscription. Such payment shall be made to the designated bank account of the Referrer.
DETERMINATION OF PARTICIPATION BY UDACITY
Udacity reserves the absolute and sole right to (A) determine the eligibility of Users for their participation in the Referral Program and (B) prohibit the Users' participation in the Referral Program at any time.
Udacity reserves the right, at its sole discretion, to prohibit any Participant from participating in any aspect of the Referral Program if Udacity deems or suspects that such Participant has engaged in or has attempted to engage in any of the following:
a) acting in violation of these RPT and/or the applicable law;
b) damaging, tampering with or corrupting the operation of the Referral Program and/or the Class Sites;
c) acting with intent to annoy, harass, or abuse any other person;
d) any inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or
e) activity deemed in the sole discretion of Udacity to be generally inconsistent with the intended operation of the Referral Program.
Udacity shall be the sole adjudicator in cases of suspected abuse, fraud, or breach of these RPT by the Participant. The Participant shall have no right to dispute her prohibition on participation in the Referral Program by Udacity. The decision of Udacity shall be final and binding on the Participant in this regard
REWARD CONDITIONS
The rewards by Udacity through the Referral Program to the Participants may be taxable. State and local tax laws may apply to the Participants. Participants are solely responsible for reporting such reward by Udacity on their tax returns and paying any associated tax liability.
Udacity reserves the sole and absolute right to cap the maximum reward amount for any Referrer at its discretion.
CONDUCT OF THE PARTICIPANTS
Participants in the Program must comply with all applicable laws including but not limited to the Indian Information Technology Act, 2000 and the rules made there under. Any distribution of the Invite Link that may constitute unsolicited commercial email or "spam" under any applicable law is expressly prohibited and shall be a ground for immediate termination of your User Account and exclusion from the Referral Program.
RELEASE
Udacity, its employees, officers and directors are not responsible or liable for any damages, or economic or emotional loss because of the Referrers' and/or the Referred Users' participation in the Referral Program. Participant releases Udacity, its employees, officers and directors from any and all claims, including claims that acts or omissions by Udacity, resulted in any damages, or economic or emotional loss because of the Referrers' and/or the Referred Users' participation in the Referral Program and/or use of the Referral Program rewards.
INDEMNIFICATION
Participants agree to indemnify, defend, and hold Udacity and its employees, officers, directors representatives and agents harmless from and against any and all third-party claims, demands, liabilities, costs, or expenses, including attorney's fees and costs, arising from, or related to any breach by the Participant of any of the terms and conditions of the RPT or any violation by the Participant of the applicable law.
RESERVED RIGHT
Udacity reserves the right to cancel or suspend the Referral Program should it determine, in its sole discretion, that the administration, security, or fairness of the Referral Program has been compromised in any way.
DISCLAIMER OF WARRANTIES
The Referral Program is provided on an "as is" and "as available" basis and Udacity expressly disclaims all warranties, conditions and terms of any kind, whether express or implied by statute, common law or custom, including, but not limited to, promises as to products or services offered through the Referral Program.
OTHER TERMS
Waiver : The failure of Udacity to exercise or enforce any right or provision of these RPT shall not constitute a waiver of such right or provision.
Severability: If any provision of these RPT is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these RPT remain in full force and effect.
